Terms and conditions

GENERAL – These General Terms and Conditions are applicable to all legal relationships between clients and the company. Any agreement shall be concluded only upon the explicit acceptance of an offer of Customer by the company.

CONDITION OF THE ARTWORKS

The Customer accepts the Artwork in the actual state at the time of purchase, or in the state described in the Contract, if such is the case. The Customer accepts the qualities of the Artwork that were known or reasonably should have been known at the time of the sale. Any deterioration in the state of the Artwork taking place after the date of purchase is for the account and risk of the Customer.

Company is not responsible for any regulatory changes of clients database, such as the name, Identity of a client after the details once provided are considered as the permanent.

PRICES, PAYMENT AND TRANSFER OF TITLE

1. All prices mentioned are in Indian rupees including Goods and service tax (GST), unless stated otherwise.

2. A Customer must pay by depositing the amount in the bank account of the company .

3. The invoice is considered as the only confirmation of the agreement.

4. The Customer will not acquire legal title to the Artwork until full payment is received by the company, in good cleared funds.

5. Full payment must be made on or before the art is collected .

6. If the company does not receive full payment by the due date, it reserves the right to exercise any legal rights it has recourse to. All resulting collection costs, and all losses resulting from the non-payment, including the costs of legal assistance, shall be for the Customer’s account.

COLLECTION AND SHIPPING

1. The Company is entitled to retain the Artwork until all amounts due to the company have been received in full in good cleared funds, and/or until the Customer has performed any other outstanding obligations the company can reasonable require.

2. Shipping costs, import and export duties, costs for packing and insurance are for the account of the Customer, unless otherwise agreed upon in writing.

3. Risk and responsibility for the Artwork (including frames) passes to the Customer upon the moment of art delivered.

4. Artworks that are delivered or made available to the Customer by the company, remain the full and unconditional property of the company, until the company has been paid the full due amount. The Company reserves the right to retrieve unpaid Artworks from the Customer.

5. The Customer shall compensate any and all damage suffered by the company due to any acts of disposition by the Customer with respect to Artworks, including the costs for retrieval, and the Customer shall cooperate with any retrieval of unpaid Artworks by the company.

6. Please be advised that all sales are final, and we are unable to accept returns or exchanges under any circumstances. We encourage you to carefully review your purchase before completing your transaction to ensure it meets your needs. Thank you for your cooperation and support!

Artwork will be delivered within 0-7 days of order placed, if any further changes will be informed prior to the delivery

LIABILITY

1.As from the moment when the Artwork is no longer the property of the company, the company no longer has any responsibility for damage or defects to the Artwork caused through the fault, or by the actions, of the Customer or of third parties, or by exterior causes.

2.The company shall not be liable towards the Customer for any loss, damage, or theft – with or without forcible entry – irrespective of the nature or the cause thereof, of an Artwork already sold but not yet delivered, except if this loss, damage or theft is covered by the insurance taken by the company, or in the case of gross negligence or intention on the part of the company.

SALE AGREEMENT

1.The sale agreement is been made only for making the transaction legitimate by Covert art company to the customer/clients.

2. This agreement includes the legal database of customer/clients, to make the process authentic between company and the buyer or the art.

Covert art privacy policy.

Your privacy is very important to us. We Covert art company are committed to the protection of your privacy. To ensure that you feel comfortable and confident about providing us with your legal personal information while communicating with us.

Our arts are not be available in any form of other E-commerce online platform/media /internet, except at our website exclusively.

The images or pictures showed by company are of pixels with low resolution to maintain the privacy of the Art.

Any kind of piracy linked activity will be punishable offense under IPC. The act of counterfeiting or piracy will involve cheating under section 415 of IPC and whoever found is liable to an imprisonment, and will be imposed with severe fine/penalty.

Company is not responsible for any kind of damage to the art after its delivery. (t and c)

SECURITY CONTROL

Any kind of unusual activity like theft of art, company provides an theft control system, in which the ART NUMBER/code will be deactivated following the evidence provided.

*Any form of unethical transfer of art (either physical/digital copy)is considered as an offensive act by the company.
